Terms of Service

By creating an account or using Oji, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use Oji.

Accounts are for adults. You must be at least 18 years old and legally able to enter into these Terms. Oji is designed for children to use, but only under the supervision of the parent or guardian who holds the account.

By setting up an account for a child in your care, you confirm that you are that child’s parent or legal guardian and that you consent to their use of Oji on the terms described here and in our Privacy Policy.

You are responsible for your account credentials and for activity that happens under your account, including your child’s use of the app. Parent settings — including daily limits and which modes and features are available — sit behind a parental gate, and you are responsible for the choices you make there.

Please tell us promptly if you believe someone has used your account without your permission.

You agree not to:

• Use Oji for any unlawful purpose, or to create or attempt to create content that is unlawful, harmful, hateful, sexual, or otherwise inappropriate for young children.
• Attempt to bypass the parental gate, the daily limits, the safety filters, or any other protective control in the app.
• Probe, scan, overload, reverse engineer, scrape, or otherwise interfere with Oji or the systems that run it.
• Resell, sublicense, or commercially exploit Oji or anything produced with it, except as these Terms expressly permit.
• Use Oji to train, fine-tune, or evaluate any machine learning model.

We may suspend or close accounts that violate these rules, and we may remove content at any time.

Oji uses generative AI to produce pictures, songs, stories, coloring books, and other content in response to what a child selects in the app. We call these “Creations.”

All Creations are the property of Oji. This includes every image, song, story, and coloring book generated through the app, and any other content Oji produces, in whatever form and however it is delivered. As between you and Oji, Oji owns all right, title, and interest in Creations, including all intellectual property rights in them. Users do not own Creations.

You may download and keep the Creations available to you in your app, as long as you credit Oji. We grant you a personal, non-exclusive, non-transferable, revocable licence to download, save, print, and share the Creations that Oji makes available in your account, provided that you attribute Oji wherever you share or display them — for example, by keeping the “oji.kids” mark that Oji adds to saved pictures and coloring book pages, or by crediting Oji in the caption or description where you post them.

This licence does not permit commercial use, resale, or use of Creations to train machine learning models. It ends if you stop using Oji or if we close your account, although Creations you have already downloaded and attributed may be kept.

Oji is an AI product, and AI systems can produce similar output for different people. We do not promise that any Creation is unique, and you should not assume that a Creation is exclusive to you.

Oji may offer a way for children to see Creations made by other children. When that feature is available, shared Creations are shown anonymously — never with a name, an account, or a timestamp — and it can be turned off in parent settings at any time. Sharing is described in more detail in our Privacy Policy.

Creations are produced by AI models and are filtered for child-appropriate output, but no filter is perfect. If something reaches your child that should not have, please tell us so we can look into it. Where the app offers a way to report a Creation, doing so hides it immediately, before anyone reviews it.

Parts of Oji may be offered as a paid subscription. If you buy one, the price, billing period, and renewal terms will be shown to you before you pay, and the purchase will be handled by the app store or payment processor you buy through. Their terms and refund rules apply to the transaction. You can cancel a subscription through the store or processor you bought it from; cancelling stops future renewals and does not refund the current period unless the law or that store’s rules say otherwise.

We are actively developing Oji. We may add, change, or remove features, and we may set or adjust limits on generation and storage. Saved Creations are subject to retention limits described in the app, which means older items can be removed to make room for newer ones.

You may stop using Oji and close your account at any time. You can delete your child’s saved Creations from parent settings.

We may suspend or end access if these Terms are broken, if it is necessary to protect other users or the service, or if we stop offering Oji.

Oji is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that Oji will be uninterrupted, error-free, or that any Creation will meet your expectations.

Oji is a creative toy, not an educational assessment, a diagnostic tool, or a substitute for adult supervision.

To the fullest extent permitted by law, Oji and S3 Group LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, use, or goodwill, arising out of your use of Oji. Our total liability for any claim relating to Oji will not exceed the greater of the amount you paid us in the twelve months before the claim, or fifty US dollars.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

You agree to indemnify and hold harmless Oji and S3 Group LLC from claims, damages, and expenses (including reasonable legal fees) arising out of your use of Oji, your violation of these Terms, or your violation of the rights of anyone else.

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of laws rules. You and we agree to the exclusive jurisdiction of the state and federal courts located in Delaware for any dispute that is not resolved informally.

If we make material changes to these Terms, we will update this page and revise the effective date above. Continuing to use Oji after a change means you accept the updated Terms.
